⚠ Airsoft & the Arms Act 1983 — Please Read

In New Zealand, airsoft guns are classified as airguns under the Arms Act 1983 and are treated similarly to firearms in terms of legal responsibility and penalties. While they do not generally require a firearms licence to own, they are subject to strict regulations regarding age, transportation, and public use.

Legal Requirements and Age Restrictions

  • Minimum Age: You must be 18 years or older to possess and use an airsoft gun.
  • Under 18s: Those aged 16 or 17 can possess an airsoft gun if they hold a valid NZ firearms licence.
  • Supervision: Anyone under 18 (without a licence) must be under the immediate supervision of a person aged 18+ or a licence holder. “Immediate supervision” means the adult must be within reach and control of the person using the airgun, and not in possession of another firearm themselves.
  • Club Membership: While not strictly required by law for ownership, many NZ retailers and clubs require proof of club membership to purchase airsoft replicas.

Legal Responsibilities

  • Public Places: Carrying an airsoft gun in a public place without a reasonable excuse (e.g., transporting to a game in a bag) is an offence.
  • Appearance: Because airsoft guns look like real firearms, carrying them openly can cause alarm, resulting in a police response and potential charges.
  • Safe Handling: Airsoft guns can cause serious injury, particularly to the eyes. Misuse or negligent, reckless handling can result in criminal charges.

Penalties and Offences

Unlawful use or possession can lead to severe penalties, including fines and imprisonment:

  • Public Possession: Carrying an airgun in a public area without a lawful purpose can lead to a fine of up to $4,000 and/or up to 3 years in prison.
  • Careless Use: Careless use that may endanger or injure someone can result in a fine of $4,000 and/or up to 3 years in prison.
  • Unlawful Pointing: Pointing an airgun at another person can lead to a fine of $1,000 and/or up to 3 years in prison.
  • Improper Display: Firing or carrying an airgun in a way that annoys or frightens people can lead to a fine of $3,000 and/or up to 3 months in prison.
  • Selling to Minors: Selling or supplying an airgun to an unlicensed person under 18 can result in a fine of $1,000 and/or up to 3 months in prison.

Importation

Airsoft guns that resemble pistols or prohibited firearms are considered “restricted airguns.” As of December 2013, importing these requires a permit from the NZ Police.
